Yesterday I posted the announcement trailer for Halo 3: Recon. When I went to YouTube looking for the trailer there were numerous versions all with various watermarks and other trivial bits. Instead of trying to figure out which one to use I decided to just upload the trailer I had downloaded from Bungie's web site to my own personal YouTube account. While the video was still processing I received the following email:
Your video "Halo 3 Recon TGS 08 Trailer" has been identified by YouTube's Content Identification program as containing copyrighted content which IGN claims is theirs.Your video "Halo 3 Recon TGS 08 Trailer" is still available because IGN does not object to this content appearing on YouTube at this time. As long as IGN has a claim on your video, they will receive public statistics about your video, such as number of views. Viewers may also see advertising on your video's page. Please note that YouTube does not mediate copyright disputes between content owners. Learn more about video identification disputes. Sincerely, The YouTube Content Identification Team I was allowed to dispute this and leave comments as a form of argument. To paraphrase myself I basically said "this video is copyright of Bungie, not IGN. Fuck them". Me? I'm all class. Meanwhile my video was never taken down and continues to run as of writing this on Thursday night. Though at 8:07pm Thursday I received a reply to my dispute (of their dispute) with basically the same info as above except for the opening sentence: In response to your dispute of a video identification match, IGN reviewed your video Halo 3 Recon TGS 08 Trailer and confirmed their claim to some or all of its audio and visual content. Keep in mind the video I uploaded was downloaded from Bungie's site, was created by Bungie and I'm pretty damn sure that fucking IGN had NOTHING to do with it. Of course, neither did I but I'm not the one trying to dispute the claim of anyone else who uploaded it. From what I could tell after a quick search there were at least five other YouTube user accounts who uploaded the same video content BEFORE IGN. They essentially just wanted to claim all the material as theirs when it was hot. Of course I think this is a real dick move on IGN's part. They're trying to use their "muscle" they think they have to get some more hits or traffic to their own YouTube channel? Give me a break. I have absolutely no problem removing the video if Bungie wants me to. I had no ulterior motives for uploading their video to my account other than having the convenience of knowing that you guys would get to see it in good quality (thanks to the newer "Watch In High Quality" option on more recently uploaded YouTube videos) and without any kind of watermark distracting you from the content. I do have a real problem with IGN trying to claim copyright on something that is not theirs. It's not even clear what they gain by doing it, other than being douche bags.
